This transcription was made using AI (Claude, by Anthropic) from photographs of the original court papers. It is an attempted transcription, not a certified copy. Faded ink, difficult handwriting, torn folds and damaged pages make some readings uncertain, and errors are possible. Check the original images before relying on any reading.

## Transcription conventions

- Original spelling, capitalization and abbreviations are kept as written.
- `[?]` = uncertain reading; `[illegible]` = could not be read; `[blank]` = a space left empty on the original.
- `[struck: ...]` = printed or written text that is lined through on the original.
- `[...]` and *[italic bracketed notes]* = editorial explanations added by the transcriber; `[letters]` inside a word = letters supplied to expand an abbreviation.
- On printed forms, handwritten fill-ins are shown in ***bold italics*** where it helps to tell them apart from the printed text.
- "PDF p." numbers refer to the page order of the source image file, which is not always the order the papers were written in.

**Notes on these images:**

- Pp. 2 and 3 are two photos of the same page, and so are pp. 11 and 12.

> And now at this day to wit, the first monday after the fourth monday in March in the year of our Lord one thousand eight hundred and twenty three to which day the said James & Joel Defendants had leave to answer to the aforesaid declaration, before the justices of the Common pleas at a Court to be held at Lancaster Court the said Jane by her attornies aforesaid and pray that the said defendants may answer to the declaration aforesaid, & though solemnly called they come not nor say anything in bar or preclusion of the aforesaid action, but makes default, whereupon she remains against them thereof undefended, whereupon she ought to have her damages sustained by reason of the premises, & because the same is a liquidated demand according to the act of the Genl. Assembly &c. it becomes unnecessary to issue a writ of enquiry, but only on motion to the court to refer the same to the Clerk thereof to ascertain the amount due & the same being so referred, the said Clerk namely William McKenna finds the amount of the principal & interest to be One hundred & nine dollars seventy one cents - Whereupon it is considered that she do recover against the said defendants the said sum so found, and also the sum of Twenty four dollars & Forty seven [sic; twenty seven] cents for her costs & charges by her expended in & about prosecuting her suit in this behalf & to her with their assent by the said Court adjudged, amounting in the whole to one hundred and thirty three dollars & Ninety eight cents & be the said Defendants in mercy &c.
